We’re Here to Help You With your Trust Matter.
Facing the loss of a loved one is challenging on many levels. For some families, trust administration is clear, relatively simple, and takes less than a year. For other families, trust administration entails uncertainty, formidable challenges, great expense, added heartache, and many months if not years to fully resolve.
Here at LaBenz Law, we understand you have particular needs during this tender time and we work to achieve a fair and efficient outcome on your behalf.
We handle both informal and formal trust administration matters in the Yavapai County Superior Court, Coconino County Superior Court, Mohave County Superior Court, and La Paz County Superior Court.
In informal trust administration, the interested parties resolve their disputes, if any, outside of court. The successor trustee administers the trust. The successor trustee collects the trust property, pays trust expenses and taxes, has the authority to sell trust property, distributes the trust property, accounts for the administration of the trust, and finally, terminates the trust.
In formal trust administration, the interested parties file their disputes with the court. Formal trust disputes may consist of a dispute about the validity of a trust document, a dispute about how to interpret one or more parts of the trust, a dispute over the beneficiaries to the trust, a dispute over title to trust property, or creditor claim litigation (note this is not an exhaustive list).
At LaBenz Law, we have experience representing successor trustees and trust beneficiaries. Furthermore, we have experience representing clients in informal and formal trust cases.
